This privacy notice for FundingHope, LLC (“FundingHope,” “the Firm,” “we,” “us,” or “our”) describes how and why we collect, store, use, and share information when you use our services, including when you visit our website at https://fundinghope.com, register or invest through our funding portal at https://invest.fundinghope.com (operated on the WealthBlock platform), or otherwise interact with us in connection with a Regulation Crowdfunding offering. FundingHope is a funding portal registered with the U.S. Securities and Exchange Commission and a member of the Financial Industry Regulatory Authority (FINRA).

Information You Provide to Us

We collect personal information that you provide directly when you create an account, complete the investor or issuer onboarding process, make an investment commitment, or otherwise communicate with us. This may include:

  • Name, mailing address, email address, and phone number
  • Date of birth and gender, as collected from government-issued identification provided during identity verification
  • Social Security number or Tax ID number
  • Billing address and payment information, including bank account, debit card, or credit card information used to fund an investment
  • Information you provide as part of investor accreditation or income/net worth self-certification
  • Government-issued identification documents, where identity verification document collection is enabled

All personal information you provide to us must be accurate and complete, and you are responsible for notifying us of any changes.

Information Collected Automatically

When you visit or use our website and platform, we automatically collect certain technical information through cookies and similar tracking technologies, including your IP address, browser and device type, operating system, pages visited, and usage patterns. We use this information to operate, secure, and improve our website and platform, and for internal analytics. We do not use this information to determine your precise physical location, and we do not collect device-based geolocation data.

Information We Do Not Collect

FundingHope does not collect biometric information (such as fingerprints or voiceprints), precise geolocation data, audio or video recordings, education records, or professional/employment history, except as may be incidentally provided by you in free-text communications.

Information Posted Publicly on the Platform

If you post a question or comment on an offering’s Q&A tab, that content is visible to other users of the platform, including the issuer and other prospective investors. Do not include sensitive personal information in any public posting. We retain Q&A communications as part of our recordkeeping obligations as a registered funding portal.

  1. How We Use Your Information

We use the information we collect to:

  • Create and administer your account and facilitate your use of the platform
  • Process investment commitments, payments, and disbursements, including through our escrow agent, North Capital Private Securities (NCPS)
  • Perform identity verification (KYC) and anti-money laundering (AML) checks, and conduct background and securities enforcement regulatory history checks on issuers and their covered persons, as required by Regulation Crowdfunding
  • Evaluate investor accreditation and investment-limit eligibility under Regulation Crowdfunding Rule 100
  • Communicate with you about your account, investments, and offerings, including required regulatory notices
  • Send marketing or promotional communications, where you have not opted out
  • Maintain the records required of a registered funding portal under SEC Rule 404 and comply with other legal and regulatory obligations
  • Detect, investigate, and prevent fraud and protect the security of our platform

We do not use your information to make automated decisions about you without human involvement, and we do not sell your personal information.

  1. How We Share Your Information

We share personal information only as described below:

  • With North Capital Private Securities (NCPS), our escrow agent, to process and hold investor funds and to perform identity verification and background checks
  • With WealthBlock, our third-party platform provider, which hosts our website, processes account and transaction data, and facilitates investor communications
  • With the issuer of an offering you invest in, to the extent necessary to process your investment and as required by Regulation Crowdfunding
  • With governmental and regulatory authorities, including the SEC and FINRA, as required by law or in connection with an examination or investigation
  • With service providers who support our business operations under contractual confidentiality obligations
  • In connection with a merger, acquisition, financing, or sale of some or all of FundingHope’s assets

We do not sell your personal information to third parties, and we do not share your personal information with unaffiliated third parties for their own marketing purposes.

  1. How Long We Keep Your Information

FundingHope is required to retain investor and offering records for a minimum of five (5) years under SEC Regulation Crowdfunding Rule 404(a), the first two years in an easily accessible location, regardless of whether your account remains open during that period. We retain your information for at least this minimum period and, in some cases, longer where required by law or our escrow agent’s own retention obligations. When retention is no longer required, we dispose of information consistent with the SEC’s disposal requirements under Regulation S-P.

  1. How We Protect Your Information

We maintain administrative, technical, and physical safeguards designed to protect your personal information, consistent with our obligations under Regulation S-P. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. If you have reason to believe your interaction with us is no longer secure, please contact us immediately.

  1. Cookies and Tracking Technologies

Our website uses cookies and similar tracking technologies, including analytics tools, to operate the site, remember your preferences, and understand how visitors use our website. When you first visit our website, you will be presented with a cookie consent banner allowing you to accept or decline non-essential cookies. You can also control cookies at any time through your browser settings. Disabling cookies may affect your ability to use certain features of our website.

We do not respond to browser Do-Not-Track signals at this time, as no uniform technical standard for recognizing such signals currently exists. If a standard is adopted that we are required to follow, we will update this notice accordingly.

  1. Children’s Privacy

Our services are not directed to, and we do not knowingly collect personal information from, individuals under the age of 18. If we learn that we have collected personal information from a child under 18 without parental consent, we will take steps to delete that information.

California Residents (CCPA)

If you are a California resident, you have the right to know the categories of personal information we collect, the right to request deletion of your personal information (subject to our legal recordkeeping obligations described in Section 4), the right to correct inaccurate personal information, and the right to opt out of the sale of personal information, which is not applicable as FundingHope does not sell personal information. We have not sold or disclosed any personal information to third parties for a business or commercial purpose, as those terms are defined under the CCPA, in the preceding twelve (12) months, and we will not do so in the future.

International Investors

If you are located in the European Economic Area or United Kingdom, you may have additional rights under the General Data Protection Regulation (GDPR) or UK GDPR, including the right to access, correct, or request erasure of your personal information (subject to our legal recordkeeping obligations described in Section 4), and the right to lodge a complaint with your local data protection authority.   1. Marketing Communications

You may unsubscribe from marketing or promotional emails at any time by clicking the unsubscribe link included in those emails or by contacting us at [email protected]. We do not send marketing communications by text message, and we do not currently offer SMS/text notifications on the platform. Even if you opt out of marketing communications, we may continue to send you non-marketing communications necessary to administer your account or as required by law.

We have not, in the preceding twelve (12) months, disclosed your personal information to any unaffiliated third party for that third party’s own direct marketing purposes, and we do not intend to do so. We share information with service providers (such as North Capital Private Securities and WealthBlock) only as necessary to operate our platform, as described in Section 3.

  1. Account Closure

If you close your account, your account information is retained, not deleted, for the retention period described in Section 4. This is necessary both to comply with our recordkeeping obligations as a registered funding portal and to deter fraud.

We may update this privacy notice from time to time. The “Last updated” date at the top of this notice reflects the most recent revision. We encourage you to review this notice periodically.
